. لا يقدم المدير أي تصريحات أو ضمانات بشأن أداء المستشار الخبير أو احتمالية تحقيق نتائج مالية معينة

جميع قرارات التداول التي ينفذها المستشار الخبير تعتمد على خوارزميات محددة وظروف السوق، والتي بطبيعتها

Investor/Trader Acknowledgment, Disclaimer &
Liability Waiver Agreement (Digital Version)
This Agreement is entered into by and between the undersigned Investor/Trader (“Investor/Trader”)
and Simon Gourgees and his companies, including but not limited to TTi and VPS (collectively referred
to as the “Manager”), in connection with the Investor/Trader’s participation in an automated trading
program managed by the Manager using an Expert Advisor (EA) on the ATC Brokers platform.
1. Acknowledgment of Risk
The Investor/Trader acknowledges and agrees to the following:
Trading in foreign exchange (Forex), contracts for difference (CFDs), and other leveraged financial
instruments involves substantial risk of loss and is not suitable for all investors.
The use of automated trading systems (Expert Advisors) carries additional risks, including but not
limited to system errors, connectivity issues, and algorithmic flaws.
Past performance of the EA or any trading strategy is not indicative of future results. There is no
guarantee of profits, and substantial losses may occur.
The Investor/Trader may lose part or all of their invested capital.
2. Role of the Manager
The Manager provides access to an automated trading strategy via an EA on the ATC Brokers
platform.
The Manager does not provide personalized investment advice or guarantee any specific outcome.
The Manager does not have discretionary control over the Investor/Trader’s funds beyond the
execution of trades via the EA.
3. No Guarantee or Warranty
The Manager makes no representations or warranties regarding the performance of the EA or the
likelihood of achieving any particular financial outcome.
All trading decisions executed by the EA are based on predefined algorithms and market
conditions, which are inherently unpredictable.
4. Limitation of Liability
The Investor/Trader agrees to hold the Manager harmless from any and all losses, damages, liabilities,
claims, or expenses (including legal fees) arising from participation in the trading program.
The Manager shall not be liable for:
Any trading losses incurred by the Investor/Trader.
Technical failures, system outages, or broker-related issues.
Errors or malfunctions in the EA or trading platform.
5. Investor/Trader Responsibility
The Investor/Trader affirms that they have conducted their own due diligence and understand the
risks involved.
The Investor/Trader is solely responsible for monitoring their account and may terminate
participation at any time.
The Investor/Trader has read and understood the risk disclosures provided by ATC Brokers.
6. Term & Termination
This Agreement shall remain in effect until terminated by either party with written notice.
Termination does not absolve the Investor/Trader of responsibility for any losses incurred prior to the
termination date.
7. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of a jurisdiction
mutually agreed upon by the parties, without regard to its conflict of law principles. In the absence of
such agreement, the governing law shall be that of a neutral and internationally recognized jurisdiction.
Digital Acknowledgment
By signing below electronically, the Investor/Trader confirms that they have read, understood, and
agreed to all terms outlined in this Agreement. This digital acknowledgment shall be deemed equivalent to a handwritten signature.
I acknowledge and agree to the terms of the Investor/Trader Acknowledgment, Disclaimer & Liability
Waiver Agreement with Simon Gourgees and his companies, including but not limited to TTi and VPS.
